Commissioners,
Please find attached my complaint against Marin County Commissioner Randolph E. Heubach.
I request that commissioner Hubach be removed for his position for gross incompetence which directly caused the death of a little girl and the amputation of her father’s leg:
Ed Shaefer a resident of Novato who had been convicted of drinking and driving six times before he drove through a Novato crosswalk on his motorcycle, killing 9 year old Melody Osheroff and leaving her father with such critical injuries that doctors had to amputate one of his legs.
Here is Ed Shaefer’s record:
• 1990: Marin County - DUI. 6 months in jail, 3 years probation, license suspended 4 years.
• 1990: Marin County - DUI. 44 days in jail, 3 years probation.
• 1991: Marin County - DUI. 26 days in jail.
• 1995: Marin County - DUI. 4 months in jail, 2 years probation, license suspended 3 years, $2,000 fine, ignition device 1 year.
• 1999: Sonoma County - Alcohol-related Reckless Driving. 30 days in jail. 2 years probation.
• 2004: Nevada - DUI.
In his first four cases, Shaefer faced the same judge: Randolph E Heubach who allowed him to keep his driving privileges four times.
Shaefer should never have been allowed to drive. The commissioner did not permanently take away his driving privileges despite the fact that Shaefer was a danger to the community and allowed him to drive, which directly caused the death of a young girl and the amputation of her father’s leg. Heubach is consequently unfit to serve as a commissioner and should be immediately removed from the court and disciplined.
The events described above have occurred on or about June 2009, have been largely documented, witnesses are available
I am filing this complaint as a California Tax payer, a parent, a Hasting graduate (class of 1995) . I worked for the Alameda’s District Attorney’s office, got to know, watch and argue in front of many commissioners and judges and can unequivocally state that Randolph Heubach is a disgrace to the profession.
I don’t expect the Marin County’s DA’s office to thoroughly investigate this matter given the cozy relationship that exists between the bench and the DA’s office. However, I expect an impartial body like yours to thoroughly investigate this matter and take action.
Should you have any doubt about the competence of this commissioner, ask yourself if you would feel safe as a parent or spouse having Randolph Heuback decide the sentences of drunk drivers.
